Can you use AI 80s photos commercially?
With 80s Filter you keep ownership of the photo you upload and the image it generates, so you can use results commercially. You still need the rights to the source photo and every identifiable person's consent, and AI-image disclosure rules may apply where you publish.
Ownership
80s Filter's terms state that you keep ownership of both the photo you upload and the image generated from it. The service takes only the limited rights it needs to run — transmit the photo to the AI provider, generate the result, and store it in your account. It does not claim your content.
What you still need
- Rights to the source photo. If a photographer took it, their rights may still apply — restyling it does not erase them. Use your own photos, or ones you are licensed to use.
- Consent of the people in it. Every identifiable person must have agreed to the photo being uploaded and restyled. For any commercial or advertising use, get that in writing.
- No implying a real person endorses you. A restyled photo of a customer in an ad still needs a model release.
Disclosure
Many platforms and some jurisdictions require AI-generated or heavily AI-edited images to be labelled. For marketing, a visible "AI-generated" note is good practice. For a social post, a line in the caption is enough.
Copyright of AI output
Copyright protection for purely AI-generated images is unsettled and varies by country — in several, an image with no meaningful human authorship may not be protectable at all. In practice this rarely matters for a profile picture or a party invite; it matters if you plan to license the image or stop others copying it.
